How long is the contract for live pairing, and can we leave early?

Live pairing (Stage 2) has a term of a year from the Stage 2 start, and then runs month to month with sixty days’ notice. In its first 90 days you may end it at any time with 30 days’ written notice. Before Stage 2 starts, you can opt out in writing within ten business days of the Floor Assessment readout and owe nothing further.

After the first yearMonth to month, with sixty days’ noticeMonthly fees up to the end date

Stage 2 starts on the first day of the month after the readout, with no further signature, unless you opt out. Its monthly fee is the greater of 10% of the extra collected against the control group and $2,500, invoiced monthly in arrears. After the first 90 days, a month with no gain still costs the $2,500 minimum until the term ends. BestPair does not guarantee a level of lift, and the Order Form says so.

Notices go in writing by email to the addresses in the Order Form. Notices of breach or termination also go by courier. Whether a notice meets the contract is a question for your counsel; BestPair does not provide legal advice.

What the first 90 days show you

Stage 2 is measured every month against a control group: 20% of accounts stay on your current routing, and both groups are scored on dollars collected per account contacted. Both groups’ results are on every invoice. Stage 2 starts on the first of a month and is invoiced monthly in arrears, so an invoice follows the end of each month, each showing how the BestPair group compared with the control group.

Early months can trail for reasons such as low adherence or small samples. Why live pairing can trail at first covers how to read them. Agree before the start what result would count for your agency, so the decision at day 90 is made on that and not on a single week.

What happens when Stage 2 ends

The Standard Terms set out what happens when the agreement ends, for whatever reason:

  • you pay the fees accrued up to that date
  • you keep the Floor Assessment report, as long as you paid for it
  • BestPair deletes your data within 30 days after the agreement ends, or sooner on written request, as the Data Processing Addendum sets out
  • any Floor Assessment credit still unused lapses

What happens to your data, the backups and the models BestPair trained on it is covered in your data and models at contract end.

What the term does not change

Stage 2 changes only which collector works each account in the BestPair group. People make every call. BestPair never dials, calls, texts or contacts consumers, and it does not change offers, scripts, whether an account is worked or any compliance rule. When Stage 2 ends, your floor goes back to routing every account the way it routes the control group today, and nothing is left installed on your systems.

Adding a campaign during the term needs its own Order Form before it is assessed or moves to Stage 2. What you sign, and in what order.

Common follow-up questions

Does the year start when we sign?

No. It runs from the Stage 2 start, which is the first day of the month after the Floor Assessment readout. The weeks of the Floor Assessment come before it and are not part of the term.

What happens to the $15,000 credit if we leave?

It lapses. The credit is applied only against Stage 2 fees above the $2,500 monthly minimum, and credit still unused a year after Stage 2 starts, or when Stage 2 ends if that is sooner, lapses. It is not paid out.

Can BestPair end the contract early?

Either party may terminate for a material breach that is not cured within 30 days of written notice, or immediately if the other becomes insolvent or enters bankruptcy. BestPair may also suspend the service if an undisputed amount is more than 30 days overdue, after ten days’ written notice.

If your shop does not qualify, you will hear it on the call, not after you have paid for a report.
